In short, neither party was willing to accept the conclusion that Moke is a generic term that can't be marked. They appealed. The court said they're tired of hearing the same argument and it's time to move on regarding Moke America's appeal. ACG appeal is still pending.

Hard to think of a Moke as generic.  Guess I'll dab my tears with a Kleenex.  Too many years, original maker long gone and lots of copies by various manufacturers. Not sure what the result will mean for the parties but probably the right result.

Looks like Moke America wins by losing. Turns out, the good judge decided that Moke is a generic term that nobody can own. 

Great news. Guess nobody is going to jail.
